Safety + Liability Waiver

Introduction

This Safety & Liability Waiver applies to all Equine-Facilitated Learning (EFL) and Equine-Guided Coaching sessions facilitated by Keren Levy.
Sessions take place at M.M. Equestrian Farm, located within Enchanted Forest Elaine Gordon Park in North Miami, FL.
While the farm provides the physical environment, all coaching services are facilitated solely by Keren Levy, who carries her own professional insurance for EFL activities.

By participating in these sessions, you acknowledge that you have read, understood, and accepted the risks and responsibilities outlined below.

1. Florida Equine Activity Statute

Florida law (Florida Statutes §773.01–773.05) limits the liability of equine professionals for injuries or death resulting from the inherent risks of equine activities.

Under this statute, equine professionals and activity sponsors are not liable for injury or death that results from the inherent risks of being near or interacting with equines, whether mounted or unmounted.

Because EFL sessions involve ground-based interaction near horses, this statute applies.

2. Nature of the Services (Ground-Based Only)

Equine-Facilitated Learning and Equine-Guided Coaching sessions:

  • Are ground-based experiences only

  • Involve no horseback riding

  • Do not include mounting, dismounting, tack use, trail riding, or any mounted activities

  • Focus on personal insight, emotional regulation, boundaries, awareness, presence, and nonverbal communication

You remain on the ground at all times.

3. Inherent Risks of Equine Activities

I acknowledge that horses are large, powerful, and sometimes unpredictable animals.
Even in calm and controlled environments, risks may include:

  • Sudden movements or reactions

  • Shifting weight or stepping unexpectedly

  • Brushing or bumping into a person

  • Startle responses to sounds, animals, or environmental changes

  • Uneven ground, natural outdoor conditions, or weather-related factors

  • The presence of other horses, people, or equipment

I understand these risks are inherent to all equine environments, including ground-based sessions.

4. Participant Responsibilities

By participating, I agree to:

  • Follow all safety instructions provided by Keren Levy

  • Move calmly and intentionally around horses

  • Avoid sudden loud noises, running, or movements that may startle an animal

  • Wear appropriate closed-toe shoes

  • Notify Keren of any physical, emotional, or sensory considerations that may impact the session

I understand that I am responsible for my own conduct and safety while on the property.

5. Non-Therapy Disclaimer

I acknowledge that Equine-Facilitated Learning / Equine-Guided Coaching:

  • Is not psychotherapy, counseling, or mental health treatment

  • Is not medical treatment or homeopathic consultation

  • Is a personal development modality designed to support awareness, growth, and self-reflection

6. Location Disclaimer (Multi-Location EFL Services)

Equine-Facilitated Learning (aka: Equine-Guided Coaching) sessions may take place at various equine facilities, private barns, retreat properties, or partner locations. These properties are independent business entities that are not owned, operated, or managed by Keren Levy or The Miami Homeopath.

Depending on the location, the facility may provide access to horses, the physical environment, or both. Regardless of the venue:

  • The facility is not responsible for the structure, content, or facilitation of coaching sessions

  • All coaching, safety instructions, and session guidance are provided solely by Keren Levy

  • Facility staff or owners do not supervise or direct the EFL session unless expressly stated

  • Participants must follow all posted barn rules and any instructions provided by facility staff when outside the coaching session

This disclaimer applies to—but is not limited to—M.M. Equestrian Farm (North Miami FL), HapBE Valley (North Carolina), and any additional sites where sessions or retreats are conducted.

7. Release of Liability

To the fullest extent permitted by Florida law, I release and hold harmless:

  • Keren Levy, The Miami Homeopath

  • Assistants, contractors, or volunteers supporting the session

  • The property owners, agents, and staff of M.M. Equestrian Farm

from any injury, damage, loss, or harm arising from the inherent risks of equine activities during my participation.

This release does not apply to acts of gross negligence or willful misconduct.

8. Parent/Guardian Consent (For Participants Under 18)

If the participant is under 18:

I confirm that I am the legal parent or guardian and that:

  • I grant permission for my child/dependent to participate in this EFL session

  • I understand that all terms of this waiver apply equally to the minor

  • I accept responsibility for their conduct and safety while on the property

  • I will remain on the premises for the duration of their session unless otherwise approved

  • I acknowledge and accept the inherent risks on their behalf

9. Digital Signature & E-SIGN Act Compliance

By checking the agreement box during booking, I acknowledge that:

  • I have read, understood, and agree to this entire waiver

  • I voluntarily choose to participate (or authorize a minor to participate)

  • I accept the inherent risks associated with being near horses

  • I agree to the release of liability stated above

  • My checkmark serves as my legally binding digital signature under the
    U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act)

No print or physical signature is required.
